By signing up with SocialSAM.com, you agree to the following Terms of Service.
SocialSAM™ (Provider) or its authorized vendors are an online information service and property lead generation system provider (the "Service"). By subscribing to our service you become an authorized user ("User") or a subscriber ("Subscriber") of the service (collectively as a "User"). As a User you may not resell, assign or transfer its membership. User agrees to pay all subscription fees prior to using the service unless authorized by Provider in writing.
Provider provides use of website and assigns User an exclusive "User ID" and Password. User will be assigned a User ID and Password for a period of time as outlined in offer and mentioned below.
Online database of properties
A user’s online account may have access to unlimited database searching of FSBO, REO, and/or other properties depending on account. New properties are consistently being added to this database on a daily, weekly, bi-weekly or other basis depending on the property type. Once a database property is approximately 90 days old, it may be deleted from the main database. If saved in an account holder personal folder it may remain viewable for later follow up. Provider makes no representation to number, or quality of properties generated to the website. Provider makes no representation that properties are available to purchase and does not make any representation as to the complete accuracy of any information posted in the database or provided by the On Demand Assistant.
On Demand Assistant™ lead screening service
Depending on your account type, you may have access to this service with which your account would include between 0-10 ODA lead screening services. Additional services can be purchased within your account along with a complete explanation of how to use this service.
Account membership and monthly reoccurring account access fee: All accounts with SocialSAM (Provider) or its authorized vendors are treated as a membership. Depending on your account type and enrolment agreement, this membership is prepaid for a term of between 0-12 months after which a user’s account will be subject to a reoccurring monthly account access fee of $49.97 to $199.97. Monthly fees are payable via credit card and users are subject to cancellation for nonpayment. Said mentioned fees are subject to change at the discretion of the provider with 30 days notice to existing user's email account.
At sign up, our new accounts department may need to contact you to conduct a “welcome call” at which time they may need to obtain your credit card information. Access to your account, along with your prepaid term (if any), will began at the completion of your account welcome call from our new accounts department. User authorizes SocialSAM (Provider) or its authorized vendors to charge their credit card per the terms outlined above. Charges will appear as SocialSAM.com
Refund policy
If user wishes to cancel their account they must make contact with our customer service department prior to the end of their prepaid term (see new account welcome email for SocialSAM.com (Provider) or it’s authorized vendors contact information), or if account is a trial offer a charge will occur on day 16 for the 1st months membership fee. Cancellations must be received prior to this charge via e-mail to billing@4realestateleads.com or by calling (866)648-1003. If refund request is made after account access fee has been charged, provider is not responsible for a refund of this charge.
Provider will send a notification email to user if their credit card declines. Immediately the account will be temporarily suspended. To reactivate account, user must call to provide updated information on credit card which will be charged the appropriate monthly account access fee. Users account will retain the same information as before account was suspended provided user reactivates account within 30 days of initial suspension.
Copyright and License of Service Content
The entire contents of the Service are copyrighted as a collective work under the United States copyright laws and except as expressly provided below, User agrees not to copy, redistribute, or publish any part of the Service. Each User may download material from the Service for his/her own non-commercial use provided User maintains all copyright and other notices contained in such material. User may not (i) redistribute that material over any network (including any local area network), (ii) sell that material, or (iii) offer for sale that material or concept. Users may not post any downloaded material to any other online service (including any bulletin board, Intranet or the Internet) without the express written permission of the copyright holder. User may make: (a) one machine-readable copy. All properties generated to Providers website are the express property of Provider; however Provider grants the use of such properties for the purposes of users possibly buying these properties. User agrees to not upload or publish any content in their advertisements that are in violation of any law, obscene, false, libelous, defamatory, racial or ethnic slurs or similar epithets. Provider may suspend any User for any violation. Failure of User to conduct themselves in a "Professional" manner shall be grounds for immediate suspension on use of service. User agrees to abide by all the Department of Real Estate Laws and or contact laws in the state in which they conduct business.
Disclaimer of Warranty
Provider makes no warranties with respect to the Service and/or information. Provider does not warrant that the functions or services performed by the service will be uninterrupted or error-free or that defects in the service will be corrected. The Service is provided in an "As-Is", as available basis. Provider makes no warranties, express (except as expressly provided herein) or implied, including, without limitation, those of merchantability and fitness for a particular purpose, with respect to the service, any information on the service, or any products or services sold through the service.
Accuracy of Information
Provider will use its "Best efforts" to keep the databases updated, but Provider does not guarantee the accuracy or completeness of any service database, or of the information contained in any such database or of any statement uploaded to the service by any User or Prospect. User understands that all data entered is in a state of flux and that a property may not be available, when they contact prospect. Provider does not endorse and is not responsible for any statement, opinion, and advice given or made on the service by anyone.
Indemnification
User agrees to indemnify, defend and hold harmless Provider, its affiliates, licensors, and their respective officers, directors, employees and agents from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, arising out of the use of the service by User or User's account.
Third Party Rights
The provisions regarding Disclaimer of Warranty, Limitation of Liability and Indemnification are for the benefit of Provider, their respective licensors, employees and agents. Each shall have the right to assert and enforce those provisions against a User.
Notices
Provider may deliver notices on the Service, by electronic mail to User via the Internet or by written communication to Users address. Users may also give notice to Provider (see new account welcome email for SocialSAM.com (Provider) or its authorized vendors contact information)
Termination
Provider may terminate this agreement at any time for any reason if User is in violation of any part of this agreement. The provisions regarding Payment, Disclaimer of Warranty, Accuracy of Information, Indemnification, and Third Party Rights shall survive the term of this agreement.
General Provisions
Any provision in any memorandum received by Provider in connection with this service, which is inconsistent with, or adds to the provisions of this agreement, is void. If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, all other terms and conditions shall remain in full force and effect.
Governing Law
This agreement and the resolution of any dispute arising hereunder shall all be governed and construed in accordance with the laws of the State of Utah, without regard to its conflicts of law principles. User consents to the jurisdiction of the courts of Utah.
By Authorizing purchase you acknowledge that you have read and accept the terms of use of this agreement from SocialSAM.com (Provider) or its authorized vendors agreement and refund request procedure as outlined in this document.
